The text of the 14th Amendment reads as follows:

Section 1. All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the state wherein they reside. No state shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any state deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.
Section 2. Representatives shall be apportioned among the several states according to their respective numbers, counting the whole number of persons in each state, excluding Indians not taxed. But when the right to vote at any election for the choice of electors for President and Vice President of the United States, Representatives in Congress, the executive and judicial officers of a state, or the members of the legislature thereof, is denied to any of the male inhabitants of such state, being twenty-one years of age, and citizens of the United States, or in any way abridged, except for participation in rebellion, or other crime, the basis of representation therein shall be reduced in the proportion which the number of such male citizens shall bear to the whole number of male citizens twenty-one years of age in such state.

Section 3. No person shall be a Senator or Representative in Congress, or elector of President and Vice President, or hold any office, civil or military, under the United States, or under any state, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any state legislature, or as an executive or judicial officer of any state, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability.

Section 4. The validity of the public debt of the United States, authorized by law, including debts incurred for payment of pensions and bounties for services in suppressing insurrection or rebellion, shall not be questioned. But neither the United States nor any state shall assume or pay any debt or obligation incurred in aid of insurrection or rebellion against the United States, or any claim for the loss or emancipation of any slave; but all such debts, obligations and claims shall be held illegal and void.

Section 5. The Congress shall have power to enforce, by appropriate legislation, the provisions of this article. Fourteenth Amendment to the United States Constitution

If I understand this the Constitution trumps any other law like the debt ceiling.

The debt ceiling raise is needed not for new spending but that that has been already authorized by Congress, ie by law and thus the President has 2 duties:
1) Uphold all laws that have been passed
2) The debt has already been committed to over many years so it is valid and "shall not be questioned.

That makes using the 14th a no brainer.

The Presidential oath also requires the President to protect and defend the Constitution. If he does not follow it as laid out above one could argue you could impeach him as well.

In fact all members of Congress took a similar oath so their inaction to provide the debt ceiling action needed to fund the laws passed by them could be deemed a violation of their oath of office subjecting Boehner in particular to impeachment. Right?

The other issue here is that failure to protect the nation's financial system from a meltdown is akin to "war" and the President again is bound to protect the nation as well. Keeping the nation from falling into a deeper recession, higher borrowing costs, higher deficits due to a double dip and the world losing faith in the US as a reserve currency makes his inaction on the 14th impeachable to me.

Failure to act has been estimated to cost the US $50B minimum directly for even a few day default due to increased debt rollover costs and as much as a trillion over a decade not to mention higher borrowing costs for consumers and business as well.


If he needs to he will act and get the job done as he should, no doubt about it.

Brett Baier disrespected a sitting President that was the only desperation I saw

Obama's Contentious Fox News Interview



I thought it was pretty big of President Obama to walk into the Fox den and do that interview not because he was desperate as I saw that one biased right wing writer here said and made fun of in the normal childish right wing way. I was impressed knowing how many times Fox has been caught in outright lies and misconceptions to falsely favor their cause of making Republicans look good and Obama fail.

Obama let go of the contention between Fox and the White House in order to reach Independents Democrats and Republicans alike who watch Faux. It was a sign of Obama's desperation to reach more people and get the truth to them. The real desperation was in the way Baier conducted the interview. You can read it below at the link but what Fox contributors called a great interview would only be called that by Faux.

Brett Baier disrespected a sitting President. He kept cutting him off! I thought it went very well despite Baier's ignorance Obama got his point across. He did nothing different. As he does at every interview and every town hall meeting he searched for the right words. You keep hearing of some fallacy called a jobless recovery. That is code for the poor needy elderly uninsured and out of work will go south but our system will be saved and that is all that matters. Healthcare must be passed or there will be no recovery of "our" economy because of the millions out of work, the millions losing there houses and the up to 50 million with no health insurance and no way to get it. No health care no recovery jobless or otherwise!

That is the way Republicans want it. If they go with this Deem and pass process and pass this without a vote the sh@$ is going to hit the fan. Down the road who knows when enough is enough, the 2nd revolution Republicans have been trying to incite from day one and even a brother of mine is calling for will happen. If Democrats resort to deem and pass it will destroy our future if it is not already.

You can bet that when Republicans get in they will do what they want, no voting any more, deem and pass everything. I have done more than a few stories on the fact that while there may be valid excuses for the animosity towards President they are merely excuses to cover the reality that is is all about racism on both sides of the color barrier. I did a story 4 days ago showing that

Having said that, I like you was disappointed in President Obama when he sided with the Black professor before knowing the facts and said Cambridge Officer Gates acted stupidly while to an unbiased eye it appears the Professor acted racist. President Obama showed even he has his ingrained racial issues. I am afraid Blacks are more guilty of racism than many whites. I am afraid the Black Reverend in the video in the above link is right saying 90% of Racist Blacks voted for Obama.

I do not care what color a person is just that they do the job at hand the best. That said, during the hearing on whether or not to admonish Joe Wilson for yelling "you lie" interrupting President Obama's speech the Black Caucus came out saying it was racial and Wilson had to be held accountable. Black Representative Hank Johnson said pretty soon we will have men riding around wearing white robes and wearing white hoods.

I found that a bit strong but I had to agree with Congressman Clyburn and certainly saw his point. He said the reason for wanting Wilson admonished had nothing to do with playing Politics. After listening to his reasons for wanting Joe Wilson rebuked I have to agree! He was a teacher his son is a teacher in Joe Wilson's District and his grandchildren go to school in Wilson's District.

Republican Boehner said this is hypocrisy and wanted to get on with the people's Business. What? They have not done the peoples business since Bush was elected! It is hypocrisy but Republicans are guilty of it. So to is Joe Wilson who called President Obama a liar and accused him of wanting to give illegal aliens medical coverage.

* I found out Joe Wilson in 2003 in the Medicare prescription modernization Act for prescription medicine under Bush that "DID cover illegal aliens. * Also was a member of the sons of confederate Veterans that has been dominated by racial extremists. In the Bill I must say as we all know, there were elements that included illegal immigrants but they were removed around a month ago. However as most also know, there is a 1986 Law "President Reagan by the way" that says illegal aliens must be treated by hospitals. That has always bothered me and that will not change.

That said, the facts in this case show Wilson is wrong and even lying or not telling the truth whatever you want to call it! However that has proven to be a plus to other racists who support him and so far have donated more than $2 million to his reelection campaign. His competition for the seat has also received around $1.5 million. It appears that creating controversy and commotion is now a way of life in gathering political contributions. I don't like this!

If Wilson just went on the floor of the House and apologized this would have gone away but then he wanted have gotten $2 million in campaign contributions. Pelosi really did want this to go away but despite what they are saying Republicans did not want this to go away and as you know they do not want to do the peoples work. Republicans want to make Health care Obama's Waterloo!

I really was stunned to hear Republican Jim DeMint politicize this so blatantly. Those asses just do not stop! This is not about Obama. This is about America. If Republicans succeed in making Health care reform fail it will be America's Waterloo not Obama's. I do not believe DeMint even said that and a bigger issue has not been made of it. Obama did say something about it but he should have named names and should pound that asinine statement home. look at Mondays exchange

We must do something! We need more affordable and better health care. Despite the fear mongering we have some great examples to follow. Republicans decry Canada's health care system touting horror stories of inefficiency and suffering. I have never heard my Canadian family members complain. I have heard nothing but good. You can hear negatives in every system especially ours.

I was listening to Canadian Health Minister Ujjal Dosanjh fielding questions about Canada's health care system because of all the disinformation Republicans are feeding the public. We keep being told Canadian Doctors are unhappy with the system and under paid. He refuted that saying Canadian Doctors like the system and do not feel they are underpaid.

He said people are not turned away as Republicans say but if you have a heart attack or something major wrong with you, you go to the head of the line. Even illegal immigrants go to the hospital no questions asked. Your taxes pay for the coverage so you pay absolutely nothing. I am so sick of Mitch McConnell's and others lies and fear mongering over Canada's health care system.

It is do or die time for Obama who is doing the big sell to both party's and around the country. Health care is in surgery! I refuse to believe that we spend twice as much on health care than other developed Nations and we have 47 million and growing uninsured. I do not need it but I refuse to believe we can not do better than this! Baucus and Grassley believe bipartisan health care reform is doable

So what is the problem? Do it and do it now! Republican's see Political Blood. I am seeing red myself. They want Obama thus us and our version of America to fail. This is not about Obama it is about getting rid of us and our version of America once and for all.Obama has been steadily destroying their new version put in place by Bush and they want to get back in place to get their version back and finish average Americans and our version off.

How are we going to pay for this? Health care is the big fight right now! We can not fail on this because the future of our society is at stake. We have blown passing this before but we can not now. Obama is going around the country pushing for passage. We will pass something but what? I for one want to know that ahead of time. If not Obama will will be creating us and him bigger problems in the future.

Obama is on a relentless media blitz to pick up Republicans and Democrats that he need while Republicans are trying to break him. Those fools think if they make health care fail they can make Obama fail. To me they are saying let health care and his version of America fail and it sickens me. They make that blatantly obvious and get away with it. That is fundamentally wrong, unpatriotic, wanting America to fail. How the hell do they get away with this?

I think Obama pointing out what DeMint about making health care fail so it will be Obama's Waterloo should be repeated often and I bet that single asinine statement will be solely responsible for getting it passed. If it does not it will be to the Republicans demise! I think we can pass something in the next couple of weeks then work on improving it.

Republicans would be smart to stop making themselves failures and make sure something is done for the 47 million uninsured and the millions having trouble paying for health care. They can then spend as much time as they want tweaking it until we have a great Health Care Bill. I have a friend in Wales touting their system and despite Republicans fear mongering Canada's system I believe 100% we have some excellent examples and better do this now and get started perfecting it not fighting it. Obama is going to get this!

* Health care is the issue of our time! Believe it or not knowing this Congress is preparing to take a months vacation. What? Obama seems to be our friend and Congress once again our enemy. People are losing their jobs, their houses, sometimes their very lives and Congress has to go on vacation for a month? Vacation from what? Failure? Obama should go public with this and force Congress to stick around until they complete this. I heard a few Democrats say they are willing to stay and get this done. Hold there feet to the fire and get this done!

I have always respected the Dalai Lama and could never fathom China being so against him and little Tibet. Yesterday I said China and the US would confront each other despite the finance situation, today for contrarians some proof!

Well guess what today brings?

The Senate Finance Committee approved a bill, by a 20-1 vote, that would allow the Treasury to take action against China by lowering its standard for identifying currency distortion. Since China stopped pegging its currency to the dollar in 2005, Senators say that the Yuan may have been undervalued by as much as 40%, making American exports to China more expensive and Chinese exports to America cheaper.The Senate Banking Committee has its own China bill, which would also make it harder for the Treasury to avoid labeling China as a currency manipulator.
The feeling is that China must be held accountable for its predatory practices. meanwhile we are watching Russia and China willing to confront us on not only a financial field but in a military field. This confrontation is growing on every front and it will end in as desired, Confrontation.

It should be Impeachment, Censure would be good, cancelled elections and Martial Law is more likely!

I wanted to talk about Senator Feingold's second effort at Censuring Bush To me he should be Impeached for too many crimes against America and our Constitution. He will escape that like he escapes all responsibility and accountability.
I wholeheartedly agree with Senator Feingold that Bush should then at the very least be censured. I noticed Harry Reid saying the damage is done to Bush so Censure is needless. I disagree 100% these fools better start realizing they must get together and stop Bush before it too late for us and the world. He must be stopped anyway possible before ha can cause more damage and attack Iran in a failed attempt to establish new middle east and world order.

I set out to write about Cheney's ongoing argument that he is above Bush's rules but of course it got deeper. First with Congress, Cheney, and Bush all ignoring each other I have to reiterate, what friggen good are they? Opinions on all of them are at record lows and they could all care less as they all continue to do nothing, do what they want, and none of them give a damn.
Bush may be President but Cheney is the real Decider. Cheney and Rove's got him elected to be cheerleader to push their agenda through. During the interim Bush has learned to be the master of Rove's taught 3 D Politics (deceitful, deceptive, divisive, Politics) to get what he wants.
During their tenure Bush has set a fine example. I should be used to the crap by now but this really stunned me. In a report to Congress, the non partisan Government Accountability Office studied a small sample of the bill provisions that Bush has signed into law but also challenged with signing statements.
The GAO found that agencies disobeyed six such laws, while enforcing 10 others as written even though Bush had challenged them.
It is a common feeling for us that what damn good is a law or anything if Bush can just rewrite it or ignore it? A signing statement is a legal document filed in the Federal Register the day a president signs a bill into law. It instructs the executive branch about how to implement the new statutes the bill creates, and sometimes it states that certain provisions are unconstitutional and need not be enforced as written.
Bush's signing statements have drawn fire because he has used them to challenge more than 1,100 sections of bills -- more than all previous presidents combined. The sample the GAO studied represents a small portion of the laws Bush has targeted, but its report concluded that sometimes the government has gone on to disobey those laws. The White House struggled to explain yesterday why President Bush complies with rules and oversight on secret documents but Vice President Cheney doesn't. However, I already have! There were also no answers about why Cheney followed the rules in 2001 and 2002 but began stonewalling on documents in 2003 as the CIA leak case was breaking and weapons of mass destruction were not to be found in Iraq. It is simple. His misdeeds and cover ups for Bush are now obviously against the law The White House simply shrugs it off and says they will check on it. Yeah right!
There are rumors that Cheney tried to abolish the government office charged with safeguarding documents, which was hounding him for access but of course it is denied.
Cheney has often cited executive privilege stemming from his office in the Bush administration to reject requests from Congress. While wer'e talking Symbolic, what are the Ramifications of a no confidence vote on Bush?

A No Confidence Vote In regard to Bush, is it possible? Can Someone tell me what the ramifications would be?
Like you I am listening to the political drama going on over the waste of time a No Confidence vote on Gonzales is. I am sick of seeing obvious corrupt people backed by Bush who says he is the Decider and what everyone else thinks and does is just a waste of their time and energy. I listen to Bush say he is more confident about Gonzales now that he remembers nothing and in light of everything that has gone wrong at least to us in this MIS Presidency and I started thinking.
We keep hearing the GOP saying trying to hold the President accountable for instigating and allowing corruption is "beneath the Senates Dignity" first I have to say nothing appears to be, including not working and looking stupid. Isn't doing the peoples work and keeping the Government and the President honest their job? Can somebody help me with this!
This morning I heard that after all this time there are still 100 unclaimed bodies from Hurricane Katrina hanging around in nondescript warehouses. That is unconscionable. What happened to caring and doing the right thing?
I understand Impeachment is the only actionable thing the Senate can do against the President or so I think. Knowing how that is going and certainly Bush deserves that and more, and that the Congress and the Senate has still officially refused to consider it, I have to ask! What would be the Ramifications of having an open vote whether the Republicans block it or not on a No Confidence Vote for the chief idiot?
I don't have to list or name the numerous situations he has mishandled whether on purpose for his new order or through corruptive ineptitude. Just say one word. Everything! He has done nothing right for the average American. He has done nothing right for "we the people" He has done nothing right for Our America. He has done nothing right in the middle east or diplomatically around the world.
Katrina, Iraq, The middle east, the world, to us he has messed everything up. To him he has done everything right as he pursues a different agenda than us and the Democratic Congress. I do not understand why a no confidence vote cannot and has not been taken against the man who would call himself a President? It would at least let the people know Bush would be held accountable and if not then it was the Republicans allowing it to continue. It may be symbolic, meaningless, and worthless for now but it would let people know that once the Democrats take everything over in 2008 there would be a return to accountability and doing the work of "we the people" and our America.
I know there would be bad ramifications around the world politically for the entire country and I certainly can't say I know how that would play it but we are driven to take desperate action to make this President do the right thing for the average American and the world not for Bush and his MIS Agenda. Would a no confidence vote on the President of the United States be doable and consequential? Please tell me what you think.
