A U.S. federal judge will hold a hearing today into whether the Bush administration violated a court order by destroying videotaped interrogations of two suspected al-Qaida terrorists by the CIA. U.S. District Judge Henry Kennedy issued an order in 2005 for the administration to preserve all evidence related to prisoner mistreatment at the U.S. naval base at Guantanamo Bay, Cuba. The judge is hearing a lawsuit brought on behalf of 16 detainees at Guantanamo. The Justice Department says the tapes were not covered under the order since there was no evidence the suspects, Abu Zubaydah and Abd al-Rahim al-Nashiri, were questioned at Guantanamo. read the idiocy
Of course they disobeyed a court order but what the hell do they care? It was done to protect the underhanded Decider and his mis-Administration so they can do what they want. why should it matter where the prisoners were questioned? That is a moot point. Torture is the issue not where it was done!
After I hear this crap that A federal judge appeared reluctant Friday to investigate the destruction of CIA interrogation videotapes while the Justice Department is conducting its own inquiry. U.S. District Judge Henry H. Kennedy is considering whether to delve into the matter and, if so, how deeply. The Bush administration is urging him to back off while it investigates. "Why should the court not permit the Department of Justice to do just that?" Kennedy asked at a court hearing.
The hearing marked the first time that administration lawyers spoke in public and under oath about the matter since the CIA disclosed this month it destroyed the tapes of officers using tough interrogation methods while questioning two al-Qaida suspects.Government lawyer Joseph Hunt said the joint Justice Department-CIA investigation into the destruction of the videos will also seek evidence of whether the government violated any court orders. Hunt promised the judge that, when the investigation is complete, lawyers will tell the court if its rules were violated."It would be unwise and imprudent" for the judge to investigate further, Hunt said.
The judge had ordered the government not to destroy any evidence of mistreatment or abuse at the Navy base in Cuba. Because the two suspects — Abu Zubaydah and Abd al-Rahim al-Nashiri — were being held overseas in secret CIA prisons, however, they are likely not covered by the order. Just over a year ago, a chastened President Bush acknowledged that his party had taken a "thumping" in the congressional elections, and he greeted the new Democratic majority at the weakest point of his presidency. But since then, Democrats in Congress have taken a thumping of their own as Bush has curbed their budget demands, blocked a cherished children's health initiative, stalled the drive to withdraw troops from Iraq and stymied all efforts to raise taxes.
